Dispute Resolution and Arbitration

Binding arbitration. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved by binding individual arbitration under the consumer arbitration rules of JAMS or AAA, as you elect.

Class action waiver. Arbitration will be conducted on an individual basis. You may not bring a claim as a plaintiff or class member in any class or representative proceeding.

Opt-out. You may opt out within 30 days of first agreeing to these Terms by sending written notice to arbitration-optout@vitalhealth.com.

Exceptions. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent imminent harm.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions.

Changes to These Terms

We may modify these Terms at any time. We will provide at least 30 days notice of material changes by email and by posting notice on this Site. Your continued use of the Site after the effective date constitutes your acceptance of the modified Terms.
